Welcome to SkillSeek (skillseek.eu). By accessing or using our website and services, you agree to comply with and be bound by these Terms of Service. Please read these terms carefully before using our platform. If you do not agree with any part of these terms, you must not use our services.

These Terms of Service apply to all users, including clients (employers), independent recruiters, and candidates.

1. Introduction

SkillSeek is a recruitment platform based in Estonia, offering services across Europe. We connect independent recruiters with businesses looking to hire talent and provide administrative, legal, and operational support for recruitment activities. By using SkillSeek, you acknowledge that you have read, understood, and agreed to these Terms of Service.

2. Eligibility

You must be at least 18 years old to use our services. By accessing our website or creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract.

3. User Accounts

3.1 Account Creation

To access certain features of our platform, you must create an account. You agree to provide accurate, complete, and current information during the registration process and to update such information to keep it accurate and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account login credentials. You agree to notify us immediately if you suspect any unauthorized access to your account. SkillSeek is not liable for any loss or damage arising from your failure to protect your account credentials.

4. Services Provided

SkillSeek offers a range of recruitment services, including:

  • For Employers: Access to independent recruiters, candidate sourcing, and tailored recruitment solutions.
  • For Recruiters: Legal and administrative support, including invoicing, contract management, and access to client job opportunities.
  • For Candidates: Opportunities to apply for job openings facilitated by our network of independent recruiters.

SkillSeek acts as an intermediary between recruiters and employers but does not guarantee specific hiring outcomes.

5. User Responsibilities

5.1 For Employers
  • Accurate Job Descriptions: You agree to provide clear, accurate, and lawful job descriptions for all roles listed on our platform.
  • Timely Payments: You are responsible for making payments in accordance with the agreed payment milestones outlined in the Recruitment Services Agreement.
  • Non-Solicitation: You agree not to solicit SkillSeek’s independent recruiters directly for services outside of the platform.
5.2 For Independent Recruiters
  • Client Acquisition: Independent recruiters are responsible for identifying potential clients and presenting qualified candidates in line with the Recruitment Services Agreement.
  • Compliance: Recruiters must comply with all applicable laws, including GDPR, and adhere to the terms of the Independent Contractor Agreement.
  • Non-Solicitation: You may not solicit other contractors working with SkillSeek to form a competing agency.
5.3 For Candidates
  • Accuracy of Information: Candidates must provide truthful and accurate information in their applications. SkillSeek is not responsible for any false or misleading information provided by candidates.
  • Job Applications: SkillSeek does not guarantee employment or specific job offers for candidates using the platform.

6. Payment Terms

All payments for recruitment services are governed by the payment schedule outlined in the Recruitment Services Agreement and Independent Contractor Agreement:

  • Milestone 1 (30%): Invoiced upon signing the Recruitment Services Agreement.
  • Milestone 2 (40%): Invoiced after the employer confirms the candidate selection.
  • Milestone 3 (30%): Invoiced 30 days after the candidate’s start date, contingent upon payment by the employer.

SkillSeek will handle invoicing to clients and remit payments to independent recruiters according to the agreed schedule. Late payments may incur interest charges as specified in the contractual agreements.

7. Intellectual Property

All content on the SkillSeek website, including text, graphics, logos, and software, is the property of SkillSeek or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or distribute any content from our website without prior written consent from SkillSeek.

8. Data Protection and Privacy

Your use of SkillSeek’s services is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal data. By using our services, you consent to our data handling practices as described in the Privacy Policy.

9. Confidentiality

Users agree to keep all confidential information received during the course of the recruitment process private and not disclose it to third parties without prior written consent. This includes but is not limited to client details, candidate profiles, and proprietary information shared through the SkillSeek platform.

10. Liability and Disclaimer

SkillSeek provides its services on an “as is” basis and makes no warranties or guarantees regarding the accuracy, reliability, or suitability of the services provided.

  • Limitation of Liability: To the fullest extent permitted by law, SkillSeek is not liable for any indirect, incidental, or consequential damages arising from the use of our services, including loss of profits or data.
  • Indemnification: You agree to indemnify and hold SkillSeek harmless from any claims, damages, or expenses arising from your use of the platform or your violation of these terms.

11. Termination

SkillSeek reserves the right to suspend or terminate your access to the platform at any time, with or without cause, including for any breach of these Terms of Service. Upon termination, any outstanding obligations, including payment and confidentiality, will survive.

12. Force Majeure

SkillSeek is not liable for any failure to perform its obligations due to events beyond its reasonable control, including natural disasters, pandemics, government actions, or other unforeseen circumstances.

13. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of Estonia. Any disputes arising out of or in connection with these terms shall be resolved through negotiation. If a resolution cannot be reached, the dispute shall be submitted to the exclusive jurisdiction of the courts of Estonia.

14. Changes to These Terms

SkillSeek reserves the right to update or modify these Terms of Service at any time. We will notify users of significant changes through our website or via email. Your continued use of our services after such changes constitutes your acceptance of the new terms.

15. Electronic Signatures and Communications

You agree to receive electronic communications from SkillSeek and consent to the use of electronic signatures for all agreements and documents related to our services.

16. 60-Day Success Guarantee

1. Summary
If you open your first client within 60 days of purchase, we’ll refund 100% of your membership fee. If you do not open a client within 60 days, no refund applies. See definitions and claim steps below.

2. Definitions

  • “Open a client” means the member has obtained a signed agreement between SkillSeek and the hiring company (e.g., services agreement or recruiting engagement letter executed by both parties).

  • “Day 1” is the calendar day the membership purchase is completed.

  • “Business days” are Monday–Friday excluding public holidays in Estonia (SkillSeek HQ).

3. Eligibility
To qualify for the refund, within the 60-day period you must:
a) Open a client as defined above (signed agreement in place).
b) Remain in good standing (no policy violations, fraud, or abuse).
c) Use your own payment method (no chargebacks or reversals pending).

4. Claim process
Email desk@skillseek.eu between Day 1 and Day 65 with:

  • Order email and purchase date,

  • A copy of the signed agreement (PDF or clear scan) showing both parties’ signatures and the date,

  • Company name, contact person, and a one-line description of the role opened.
    We will review and respond within 10 business days.

5. Refund method
Approved refunds are issued to the original payment method. One refund per customer account. Refund covers the membership fee paid; it does not cover external ad spend or third-party tools.

6. Exclusions
Claims may be denied if: (i) the agreement is unsigned, altered, or cannot be validated; (ii) you are suspended for policy breaches, abusive behavior, or fraud; (iii) a chargeback is initiated; (iv) you previously received a membership refund within the last 24 months.

7. Changes
We may update this policy for future purchases. Changes do not affect members who purchased before the change. The current version is posted on this page.

8. Governing law
Estonian law; courts in Tallin have jurisdiction, unless mandatory consumer laws in your country provide otherwise.
